Sunset Tribe Gear Rental – Terms & Conditions

By renting equipment from Sunset Tribe Gear Rental (“we”, “us”), you (“Renter”) agree to these Terms & Conditions. Please read carefully before confirming your booking.
1. Rental Agreement
This Rental Agreement (“Agreement”) is made effective on the date the Renter signs this Agreement and pays the rental invoice. The Agreement is between Sunset Tribe Gear Rental (“Lessor”) and the Renter (“Lessee”), collectively referred to as the “Parties.”
By confirming a booking, the Renter agrees to lease the equipment specified in the Booking Form (“Rental Equipment”) in accordance with this Agreement.
2. Rental Period
- The minimum rental period is 2 nights.
- Drop-off days are not charged.
- The rental period begins on the agreed collection date and ends on the agreed return date.
- Equipment must be returned in good condition unless prior arrangements for extension are made in writing.
3. Collection & Return
- Collection and return must be arranged with us and occur Monday to Friday, 10:00 – 16:00.
- Collections or returns outside office hours require prior written approval.
- Late returns incur an additional daily rental fee plus 50% of the daily rate for each day late.
4. Payments & Deposits
- Full payment is required before collection.
- A refundable deposit may be required and will be refunded within 7 business days if equipment is returned in good condition.
- The Renter is responsible for costs related to the safe removal and return of equipment if it cannot be returned as agreed.
5. Refund Policy
- More than 30 days’ notice before the rental start date: full refund.
- 10–30 days’ notice: 50% refund.
- Less than 10 days’ notice: no refund, but 100% credit is applied to the Renter’s account for future rentals.
- Refunds are made to the original payment method within 7 business days of cancellation.
6. Use of Equipment
- Equipment must be used safely, carefully, and according to its intended purpose.
- The Renter shall comply with all applicable laws and regulations in South Africa and any other country where equipment is used.
- Equipment must not be sublet, materially altered, used by unlicensed drivers, taken across borders without written permission, or exposed to pets, smoking, or open flames.
7. Repairs & Maintenance
- We maintain the equipment in good working order.
- The Renter may not repair or modify equipment.
- Any pre-existing damage must be reported immediately upon collection.
8. Risk & Insurance
- The Renter assumes all risk from collection until return.
- The Renter is liable for damage, loss, or theft unless covered by our insurance.
- Our insurance covers damage, loss, fire, theft, and collision, reducing the Renter’s liability to the excess of the policy.
- If the Renter breaches this Agreement or any additional driver does so, the Renter is fully liable for all costs.
9. Surrender of Equipment
- Equipment must be returned in good condition.
- Acceptance by us upon return does not waive our right to assess condition and charge for damages if necessary.
10. Indemnity
The Renter indemnifies and holds harmless Sunset Tribe Gear Rental from any claims, costs, damages, or liabilities arising from the use of the rental equipment.
11. Ownership & Assignment
The rental equipment remains the sole property of Sunset Tribe Gear Rental. The Renter has no ownership rights except as expressly provided in this Agreement.
12. Breach
- Breach of any term allows us to immediately terminate this Agreement, reclaim equipment, and charge for damages.
- The Renter is liable for legal costs on an attorney-and-own-client basis and interest at prime + 2% per annum on outstanding amounts.
13. Governing Law & Jurisdiction
- This Agreement is governed by the laws of South Africa.
- The Renter consents to the jurisdiction of the Magistrate’s Court for any legal action arising from this Agreement.
14. Entire Agreement
This document constitutes the full Agreement between the Parties. Any changes must be in writing and signed by both Parties.
